According to the report, the FCC did not immediately comment on Huawei’s objection.

The FCC passed a decision on November 22 last year that identified Huawei as a national security threat to the United States and prohibited operators in rural areas of the United States from using the Universal Service Fund (USF) to purchase Huawei equipment.

In its indictment to the US Fifth Circuit Court of Appeals, Huawei believes that the FCC has directly identified that Huawei poses a national security threat and does not give Huawei an opportunity to rebut relevant claims that violate the judicial principle. Huawei also believes that the FCC has not provided any evidence or reasonable reason to support its arbitrary decision in violation of the US Constitution, Administrative Procedure Act, and other US laws.

Regarding this approach, Huawei’s chief attorney Song Liuping said, “We are banned just because Huawei is a Chinese company and we cannot solve any cybersecurity issues.”
